O.A.No.370 of 2019 in C.S.No.240 of 2019 R.SUBRAMANIAN.J., Counter has been filed along with the typed set of papers and an application to vacate injunction has also been filed in A.No.3885 of 2019.

2. The contention of the learned counsel for the respondents is that the plaintiff who was paying rents to all the defendants for her occupation of the suit 'A' Schedule property has stopped paying rents from November 2018. Certain receipts have also been produce to show that a sum of Rs.12,000/- was fixed as rent and the plaintiff has been paying 1/4th of the said sum to each of the defendants 1 to 3.

3. The learned counsel for the plaintiff also does not dispute the said claim.

4. Hence, the order of injunction is modified and the same will continue subject to the condition that the plaintiff pays rent at the rate of Rs.3,000/- per month to each of the defendants 1 to 3 from December 2018 and shall continue to pay the same till the passing of the final decree in the suit. The amount so paid will be adjusted in the mense profits to be determined.

5. In the even of default, the defendants would be entitled to take suitable action.
