The petition has been filed seeking to condone the delay of 771 days in paying the deficit Court fees of Rs.46,110/- which is required to be paid in the appeal.
2. In the affidavit filed, which was actually filed by the Junior counsel, it had been stated that the appeal papers on being returned by the registry, had been misplaced in the office and thereafter had been recorded. The lock down period then commenced owing to the covid-19 pandemic. There had been delay in paying the deficit Court fees.
4. In view of the reasons stated, the Civil Miscellaneous Petition is allowed.
5. Registry to number the A.S.(SR).No.19084 of 2020 if it is otherwise in order.
