ORDER

The petitioner, who has been arrayed as A3 in Crime No.294 of 2022 for the offences punishable under Section 420 IPC, has filed this Criminal Original Petition seeking to quash the proceedings as against him.

2. The contention of the petitioner is that he was not originally named in the case and he was arrayed as the third accused solely on the basis of the confession of A2, namely Senthil Kumar. The petitioner was employed as a collection agent in Ujjivan Small Finance Bank Ltd., and he, along with the second accused, collected a sum of Rs.1,500/- from one Vasantha on 01.07.2021, obtained her signature and issued a receipt. Thereafter, on 14.02.2022, the second accused alone visited the house of Vasantha and informed her that a summons had been received from the Court for her appearance before the Lok Adalat on 15.02.2022. The petitioner contends that he had no role in the creation or service of the said summons.

3. The learned Government Advocate (Crl. Side) submitted that the summons were created by the petitioner along with the other accused and signed the same as though the second respondent is the Junior Administrative Officer of the District Legal Service Authority. Such an act was committed for the purpose of cheating and to show that the amount has been settled to the

borrowers. The second accused has confessed regarding the role of the petitioner and the investigation is still in progress.

4. Considering the submissions made on either side, this Court directs the respondent Police to proceed with the investigation. If the petitioner's contention is found to be correct, appropriate action shall be taken. The final report shall be filed within a period of three months from the date of receipt of a copy of this order.
