2. Though the respondent is served with notice, none appears before this Court.

3. I have gone through the affidavit filed in support of this petition and I am of the view that the delay of 1350 days is condoned on condition that the petitioner shall forfeit the interest for the delay period of 1350 days and this petition is accordingly ordered.
