C.M.P.No.7197 of 2023 in C.M.A.SR.No.32684 of 2023 N.MALA,J, This petition is filed to condone the delay of 1127 days in filing the above C.M.A.SR.No.32684 of 2023.

2. Though notice has been served on the 1st respondent, he has not appeared before this Court.

3. Ms.G.Sukumari, learned counsel appears for the 2nd respondent and she fairly submits that she has no objection to the delay of 1127 days being condoned, subject to the condition that the petitioner/claimant shall not be entitled to interest for the delay period of 1127 days.

4. In view of the above submission made by the learned counsel for the 2nd respondent, the delay of 1127 days is condoned and the petition is accordingly ordered, on condition that the petitioner shall forfeit the interest for the delay period of 1127 days.
