The petitioner, who was arrested and remanded to judicial custody on 06.02.2026 for the offence punishable under Sections 5 of Explosive Substances Act, 1908 and Section 9(B)(1)(b) of Explosives Act, 1884 in Crime No.75 of 2026, registered on the file of the respondent, seeks bail. 1/4

2. The allegation against the petitioner is that the petitioner joining hands with other accused illegally transported 178 Nos of gelatin sticks in a two wheeler. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner was not aware of the contraband he was carrying while he was travelling with other accused. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (crl. Side) reiterated the prosecution case and submitted that the quantity of the contraband transport is very high and it is transported in a two wheeler and also the investigation in this case is pending. Hence, he opposed for grant of bail to the petitioner.

Considering the fact that the 178 Nos of gelatin sticks and other connected materials were involved in this case and they were transported in a two wheeler and the investigation is pending and also the fact that some of the accused is still is absconding, this Court is not inclined to grant bail to the petitioner.
