This petition is filed under Section 378 Cr.P.C, to grant special leave to prefer an appeal against the judgment dated 12.01.2023 made in S.T.C.No.1 of 2019 on the file of the Judicial Magistrate, Fast track Court at Poonamallee.
2. Heard Mr.B.Janakiram, learned counsel for the petitioner.
3. Learned counsel for the petitioner contended that though the accused had admitted his signature on the cheque, the trial Court had held that there is no legally enforceable debt. Moreover, the trial Court had observed that there is no communication between the complainant and the accused in between November 2014 to October 2018 whereas the cheque was issued on 01.11.2014.
4. According to the learned counsel for the petitioner, there are arguable points in the main appeal and therefore, special leave is granted as prayed for.
