JUDGMENT

(Judgment of the Court was made by C.v.Karthikeyan, J.) By order dated 29.03.2021, a Co-ordinate Division Bench of this Court had while examining the merits of the appeal stated that there is no perversity in the order passed by the learned Single Judge who had directed return of plaint and to re-present the same before the appropriate forum. 2.It is now informed by the learned counsel for the respondents that the plaint had been re-presented before the District Court, Kancheepuram and numbered as OS No.1871 of 2021 and it is now pending. The only reason why the appeal was kept pending before this Court was the examination of the Court fees payable and that issue has been subsequently resolved by introducing amendment to the Tamil Nadu Court Fees and Suit Valuation Act, 1955. 3.Since no issue arises for adjudication and as has already been indicated, we would now record that the appeal stands dismissed. No costs. The parties are permitted to proceed further with the civil suit now pending before the District Court, Kancheepuram.
