ORDER

The writ petition has been filed seeking the following relief : " To issue a Writ of Mandamus directing the respondents to forthwith issue the Work Site Inspection Certificate to the petitioner as mandated under Clause 9 of Tender Notice No. 15/202526/CMDP/DO dated 03.02.2026 and to forbear the respondents from opening the tender applications pertaining to Tender Notice No.15/2025- 26/CMDP/ DO dated 3.02.2026 without issuing the certificates and accepting the bid application of the petitioner"

The petitioner would submit that the 2nd respondent has floated a tender notice dated 03.02.2026, for the construction of Road Over Bridge at Km75/6 of Chennai-Tiruttani-Renigunta Road and the deadline for submission of bids through online was on 23.02.2026 till 11.00 hrs. The petitioner who is the registered Class-I Contractor, engaged in the business of construction of major civil infrastructure projects including highways, bridges, and road over bridges etc., wanted to participate in the said tender and had addressed a written representation on 17.02.2026 to the 1st

respondent seeking issuance of Work Site Inspection Certificate and Machinery Certificate, which are the mandatory documents as per Clause 9 of tender conditions. The petitioner had also deputed his authorised personnel on 20.02.20256 to collect the said certificates. In addition, the petitioner has also reiterated its request through email dated 21.02.2026. Despite several correspondences and the petitioner having complied with all procedural requirements, the first respondent had neither issued the said certificates and nor had stated the reasons for non-issuance of such certificates. Hence, the petitioner is before this Court with the above writ petition.

3. Heard the learned counsel for the petitioner and this Court also perused the documents filed in support of this writ petition.

4. Today, when the matter is called Mr.Narayanan, the Divisional Engineer, Highways Department, Chennai Metropolitan Development Plan, Division III, Guindy, is present before the Court.

5. Mr.V.Jeevagiridharan, learned Additional Government Pleader appearing for the respondents would submit that the Work Site Inspection Certificate and Machinery Certificate has been issued to the petitioner today (i.e., 23.02.2025), the last date for submission of the bid, and as a special

concession, the time for submitting the Work Site Inspection Certificate and Machinery Certificate insofar the petitioner is concerned, is extended till 11.00 hrs on 24.02.2026 by the second respondent.

6. Recording the above statement, the writ petition is disposed of. No costs.
