Prayer :- Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus directing the 2nd respondent to consider the petitioner's representation dated 09.10.2017 for transfer her from the Government Higher Secondary School, Pitharkadu, Nilgiris District, to any one of the relevant school in Kanyakumari District.

O R D E R

The Petitioner who was selected and appointed as a Physics Teacher vide Appointment Order dated 30.01.2006, by Teachers Recruitment Board, is working in the Government Higher Secondary School at Pitharkadu, Nilgiris District. Since then, she has been continuously working as a Teacher in the said school, although her native district is Kanyakumari, wherein, her husband is living with his age old parents and she with her daughters living in Nilgiris. It is further stated that since

their family is living in two places and the distance between Kanyakumari and Nilgiris is nearly 750 kms, the petitioner is unable to make frequent visit to her native district, where her husband and in-laws reside.

The petitioner's contention is that she has been serving in Government Higher Secondary School, Pitharkadu, Nilgiris District, for 11 long years and even though she attended counselling for transfer, her application for transfer was not considered. The petitioner also given a representation dated 09.10.2017 by citing her inability to take care of her family members and sought transfer to any one of the school in Kanyakumari District.

3. Mr.V.Jayaprakash Narayanan, learned Special Government Pleader, taking notice on behalf of the respondents, submits that eight weeks time may be granted to the 2nd respondent to consider and dispose of the representation of the Petitioner dated 09.10.2017.

4. In view of the above submission, without going into the merits of the matter, this court directs the 2nd respondent to consider the representation of the Petitioner dated 09.10.2017 and dispose of the same within a period of eight weeks from the date of receipt of a copy of this order, keeping in mind that the Petitioner is serving in the Government Higher Secondary School, Pitharkadu, Nilgiris District, for 11 long years, by staying away from her husband and in-laws, who reside in Kanyakumari.

This Writ Petition is disposed of with the above direction. No costs.
