ORDER : The Court Made the following order :- The petitioner is an accused in Crime No.24 of 2019 for the offences punishable under Sections 376(1) of IPC r/w.Section 3(a), 4, 5(1), 6, 17 of the Protection of Child from Sexual Offence Act, 2012, seeks anticipatory bail.
2. The accusation is that the petitioner(A4) has felicitated the marriage of her grand daughter, who was a minor at that relevant time, to a visually challenged Nigerian. The Nigerian is also elder to the girl by several years.
3. The learned counsel for the petitioner submitted that the petitioner is a senior citizen. He also submitted that the other co-accused has been granted bail and hence, prays this Court to grant bail to the petitioner.
4. Opposing the bail, the learned Government Advocate (Criminal Side) makes a statement that the charge sheet in this case has been laid and the petitioner is notified as absconding.
5. Since the charge sheet is already laid, the petitioner is now required to surrender and move for a regular bail before the concerned Sessions Court. Since, the petitioner is stated to be a senior citizen, the Court concerned may dispose of the matter on its own merit, on the same day.
