PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of mandamus directing the fourth respondent to demolish the illegal, unlawful, unauthorised multistoried construction put up by the 6th respondent in Survey No.T.S.No.5 of Shanmugapuram, Kodaikanal, Dindigul district and directing the 3rd and 7th respondents to dismantle the electricity service connection No.252/009/1628 stands in the name of the 6th respondent.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) This writ petition has been filed by the petitioner seeking a writ of mandamus directing the fourth respondent to demolish the illegal, unlawful, and unauthorised multi-storied construction put up by the 6th respondent in T.S.No.5 of Shanmugapuram, Kodaikanal, Dindigul district and further directing the 3rd and 7th respondents to dismantle the electricity service connection No.252/009/1628 stands in the name of the 6th respondent.

2. Mr.R.Vijayakumar, learned Additional Government Pleader accepts notice for respondent Nos.1 and 4.

3. The sixth respondent is a private respondent, who is alleged to have put up unauthorised construction in T.S.No.5 of Shanmugapuram, Kodaikanal, Dindigul District.

4. The office of the 4th respondent shall cause inspection of the site in question i.e., T.S.No.5 of Shanmugapuram, Kodaikanal, Dindigul District to be made within a fortnight from the date of receipt of a copy of this order and if any illegal construction is found, all the official respondents shall take action in accordance with law, after giving notice to all concerned, particularly the sixth respondent before us, and conclude the proceedings within a period of two months thereafter.

5. The writ petition, accordingly, stands disposed of. No costs.
