(By J.Nisha Banu,J.) Challenging the conviction and sentence imposed by the Sessions Judge, Karaikal in S.C.No.6 of 2017 dated 24.08.2018, the appellant / A2 is before this Court.

On the previous hearing, though it was represented by the learned counsel for the appellant that the appellant died, there was no documentary proof produced before this Court and therefore, this Court directed the learned Public Prosecutor (Puducherry) to ascertain the factual position and report to this Court.

3. When the matter is taken up for hearing, it is affirmed by the learned Public Prosecutor (Puducherry) appearing for the Respondent that the appellant / A2 died and the instant Appeal may be dismissed as abated.

4. In view of the above, this Criminal Appeal is dismissed as abated.
