(Order of the Court was made by SUNDER MOHAN, J.) The petitioner has filed the above Criminal Miscellaneous Petitions seeking modification/relaxation of the conditions imposed by this Court in different cases and prays that he may be permitted to appear before the Principal District and Sessions Court, Coimbatore/Special Court, once a week and before the trial Court on the hearing dates.

2. The learned Additional Public Prosecutor on instructions submitted that the petitioner has been complying with the conditions regularly and he may be directed to appear before the trial Court on all hearing dates and also before the Principal District and Sessions Court, Coimbatore/Special Court, twice a week.

3. Considering the fact that the petitioner is facing trial in different

cases before different Courts, we are of the view that the conditions imposed on the petitioner in all the above cases shall be modified/relaxed as follows: (a) The petitioner shall appear before the Principal District and Sessions Court/Special Court, Coimbatore, once in a week i.e., on Monday at 10.30 a.m.

(b) The petitioner shall appear before the trial Court on all hearing dates in the trial.

(c) It is also made clear that his appearance can be dispensed with only under extraordinary circumstances and the petition under Section 317 of the Cr.P.C., shall not be entertained on mere asking.

4. With the above modification/relaxation, these Criminal Miscellaneous Petitions stand allowed.
