(CRIME NO.5 OF 2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition i.e (c) the petitioner shall stay at Ramanathapuram and report before the Ramanathapuram Town Police Station daily at 10.30 a.m., for a period of 3 months and thereafter, he shall report before the respondent police daily at 10.30 a.m., until further orders and should appear to the court hearings regularly to the petiitoner to appear before the trial court i.e Sessions Judge, Special Court for Exclusive Trial of POCSO Cases under Pocso Act at Chennai. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. M.SURESH, Advocate for the petitioner and of MR.R.KISHORE KUMAR, Govt.
Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify one of the conditions imposed on him by this Court in Crl.O.P.No.24581 of 2021 dated 22.12.2021 and the same was modified by this Court by an order dated 12.04.2022. Now, at the instance of learned counsel appearing for petitioner seeking for clarification in the order, this matter has been listed today.
2. The learned counsel for the petitioner submitted that while modifying the condition imposed by this court on 12.04.2022, directed the petitioner to report before the trial court on every Wednesday at 10.30 a.m. apart from regular court hearings for a period of three months and there is no modification with regard to the condition to report before the respondent police daily at 10.30 a.m. until further orders. Hence, the matter has been listed today.
3. Considering the above submission, the condition to report before the Ramanathapuram Town Police Station is modified to that effect that the petitioner shall report before the Trial Court on every Wednesday at 10.30 a.m. apart from regular Court hearings for a period of three months and the petitioner need not appear before the respondent police daily.
4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 24581 of 2021 vide order dated 22.12.2021 shall remain unalterted.
