..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondent to consider the petitioner's representation dated 06.02.2023 for issuance of Patta in favour of the petitioner in respect of Plot No.23, comprised in Survey No.899/1, measuring to an extent of 1520 sq.ft., situate at Hosur Village & Taluk, Krishnagiri District, without insisting upon NOC from Tamil Nadu Housing Board.

ORDER

This writ petition is filed to direct the respondents to consider the petitioner's representation dated 06.02.2023.

2. Learned counsel for the petitioner would submit that the petitioner

made a representation dated 06.02.2023 for issuance of Patta in favour of the petitioner in respect of Plot No.23, comprised in Survey No.899/1, measuring to an extent of 1520 sq.ft., situate at Hosur Village & Taluk, Krishnagiri District, without insisting upon NOC from Tamil Nadu Housing Board. However, the same was not considered, as on date. Hence, this writ petition.

Learned Additional Government Pleader appearing for the respondent would submit that the Tamil Nadu Housing Board has preferred an appeal against the order dated 08.09.2022, passed by this Court in W.P.No.19306 of 2018. As the said appeal is currently pending before this Court, he prays for appropriate orders.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In view of the above, it is made clear that pending writ appeal will no way prevent the respondent from considering the petitioner's representation. If the said appeal is allowed in favour of the respondent, upon the production of the said appeal order, the patta, if any issued already, will get cancelled automatically. Therefore, the right of the Tamil Nadu Housing Board is no way going to be affected by considering the petitioner's representation. Hence, this Court directs the respondent to consider the petitioner's representation

dated 06.02.2023, after issuing due notice and opportunity of personal hearing to the petitioner as well as the Tamil Nadu Housing Board and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
