District, without insisting upon NOC from Tamil Nadu Housing Board. For Petitioner(s):

ORDER

This writ petition is filed to direct the respondents to consider the petitioners' representation dated 06.03.2023.

Learned counsel for the petitioners would submit that the petitioners made a representation dated 06.03.2023 for issuance of joint patta in favour of them in respect of land bearing Plot Nos.25 and 45, measuring to an extent of 1200 sq.ft., each totally measuring to an extent of 2400 sq.ft., comprised in Survey No.899/1, situate at Hosur Village and Taluk, Krishnagiri District without insisting upon NOC from the Tamil Nadu Housing Board. However, the same was not considered, as on date. Hence, this writ petition.

Learned Standing Counsel appearing for respondents 2 and 3 would submit that the Tamil Nadu Housing Board has preferred an appeal against the order dated 17.10.2022, passed by this Court in W.P.No.1731 of 2017. As the said appeal is currently pending before this Court, he prays for appropriate orders.

4. Heard the learned counsel on either side and perused the materials available on record.

5. In view of the above, it is made clear that pending writ appeal will no way prevent the respondents from considering the petitioners' representation. If the said appeal is allowed in favour of the respondents, upon the production of the said appeal order, the patta, if any issued already, will get cancelled automatically. Therefore, the right of the Tamil Nadu Housing Board is no way going to be affected by considering the petitioners' representation. Hence, this Court directs the first respondent to consider the petitioners' representation dated 06.03.2023, after issuing due notice and opportunity of personal hearing to the petitioners as well as the Tamil Nadu Housing Board and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. With the aforesaid direction, this writ petition stands disposed of. No costs.
