Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus directing the 1st respondent to pass order pursuant to the proposal made by the second respondent to the 1st respondent in proceedings of Na.Ka.En. 8949/2013/P4, dated 05.02.2014 and accordingly revise the petitioner's pension benefits and pay the arrears of pension and other pensionary benefits with interest at the rate of 24%. O R D E R

The petitioner was initially appointed as Medical Officer on 19.3.1979. Thereafter, he was promoted as Chief Medical Officer. The petitioner on attaining the age of superannuation retired from service on 31.10.2009.

2. The petitioner was granted one increment for acquiring Diploma in Anaesthesiolagy based on G.O.Ms.No.2679 Health and Family Planning Department dated 27.11.1964. The Assistant Director of Local Fund Audit, Thiruvarur, by proceedings dated 27.11.1964, audited his service and certified that he was granted the above increment. Pursuant to G.O.Ms.No.2679 dated 27.11.1964, the second respondent forwarded a revised pension proposal to the first respondent along with the audit report by proceedings dated 05.2.2014. However, there was no follow up action taken by the first respondent to pass orders pursuant to the proposal. https://hcservices.ecourts.gov.in/hcservices/

The first respondent is directed to consider and dispose of the representation dated 23.9.2013 submitted by the petitioner in the light of the proposal made by the second respondent dated 05.2.2014. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

4. The petitioner is directed to forward a copy of the representation dated 23.9.2013 along with the copy of the proposal dated 05.2.2014 so as to enable the first respondent to dispose of the matter as expeditiously as possible.

5. The writ petition is disposed of with the above direction. No costs.
