Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the first respondent herein dated 28.10.2013 in his proceedings Na.Ka.No.8402/A1/2013 and quash the same consequently direct the second respondent to include the name of the petitioner by removing the name of the third respondent in Index II of Encumbrance Certificate with relating to the Sale Deed Document Nos.1452 and 1453 of 1965.

This writ petition has been filed to issue a Writ of Certiorarified Mandamus to call for the records pertaining to the impugned order passed by the first respondent herein dated https://hcservices.ecourts.gov.in/hcservices/

28.10.2013 in his proceedings Na.Ka.No.8402/A1/2013 and quash the same consequently direct the second respondent to include the name of the petitioner by removing the name of the third respondent in Index II of Encumbrance Certificate with relating to the Sale Deed Document Nos.1452 and 1453 of 1965.

2. The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this Writ Petition.

3. In view of the submission made by the learned counsel for the petitioner, this Writ Petition is dismissed as withdrawn with liberty to look out the remedy before the Civil Court between the petitioner and third respondent. No order as to costs.
