D. Rajalakshmi v. S. Padmanabhan

2022-06-20Honourable Mrs Justice J. Nisha Banu1 pages

C.M.P.No.6941 of 2019 in Tr.C.M.P.No.267 of 2018 J.NISHA BANU, J., Perusal of records would go to show that notice to the sole respondent was ordered on 29.03.2021 and service is awaited for the same. Subsequently, when the case was listed on 06.06.2022 and 16.06.2022, there was no representation made on behalf of the petitioner. Therefore, this Court had directed the Registry to list this matter under the caption "for dismissal".

2. Today, i.e. on 20.06.2022, when the matter is taken up for hearing, there is no representation made on behalf of the petitioner. Since the petitioner is not present before this Court, it can now be inferred that the petitioner is not interested to prosecute this case.

Accordingly, this miscellaneous petition stands dismissed for non-prosecution.
