C.M.P Nos.5626, 5628, 5636, 5637 & 5638 of 2024 in C.M.A No.1566 of 2001 ABDUL QUDDHOSE, J These five applications have been filed i) to condone the delay of 6910 days in filing the petition to set aside the abatement caused due to the death of the 1st appellant, in the main appeal, ii) to set aside the abatement caused due to the death of the 1st appellant in the main appeal, iii) to set aside the abatement caused due to the death of the 2nd appellant in the main appeal, iv) to bring on record the the 4th petitioner and respondents 13 and 14 as the legal representatives of the deceased 2nd appellant and rank them as 7th appellant and respondents 13 and 14 in the main appeal and v) to bring on record the petitioners 2 and 3 and 12th respondent as the legal representatives of the deceased 2nd appellant and rank them appellants 5, 6 and 12th respondent in the main appeal.

2. All the respondents have been duly served. 1/4

3. Learned counsel for the respondents has no objection in allowing these applications.

4.This Court is also satisfied with the reasons contained in the affidavits filed in support of the petitions in C.M.P Nos.5626, 5628, 5636, 5637 and 5638 of 2024 as sufficient cause has been shown.

5. Accordingly, the petitions in CMP Nos.5626, 5628, 5636, 5637 and 5638 of 2024 are allowed as prayed for.

6. Registry is directed to carry out the necessary amendment in the cause title and list the main appeal on 06.06.2024 for arguments. 03.04.2024 uma (2/2) 2/4
