ORDER

This Writ Petition is filed to issue a writ of mandamus directing the fourth respondent not to entertain any request from the fifth respondent for grant of patta in respect of the petitioner's land at No.1, First Street, South Bakthavachalam Nagar, Chennai 600 061, survey No.45 Thalakancheri Village to the extent of 5 cents and consequently direct the respondents 1 to 4 to permit the petitioner occupation of the land situated at No.1, First Street, South Bakthavachalam Nagar, Chennai 600 061, survey No.45 Thalakancheri Village to the extent of 5 cents on the basis of the Patta granted to the petitioner on 05.09.2008 by Tahsildar, Tambaram.

2. The learned counsel for the petitioner submitted that the sole petitioner died. The writ petition has been filed to direct the fourth respondent not to entertain any request from the fifth respondent for grant of patta in respect of the petitioner's land. After demise of the sole petitioner, the legal heirs did not give any further instructions to proceed with the writ petition.

3. The legal heirs of the deceased petitioner did not take any step to implead themselves to represent the petitioner. Accordingly, this writ petition is dismissed as abated. Consequently, connected miscellaneous petition is closed. No order as to costs.
