Contempt petition filed under Section 11 of Contempt of Courts Act (Amendment), 2006 - 1971 praying to punish the respondent herein for his willful disobedience of the order dated 30.09.2016 passed by this Court in C.P.No.97 of 2016.

ORDER

1.This contempt petition is filed alleging wilful disobedience of the order dated 30.09.2016, passed by this Court in C.P.No.97 of 2016.

2.Mr.Nithyesh Natraj, Advocate, has entered appearance on behalf of the respondent. The learned counsel says that the respondent will pay a sum of Rs.14 lakhs owed to the petitioner in the following manner:

(i)Rs.4 lakhs would be paid on or before 30.10.2017. (ii)Remaining sum of Rs.10 lakhs would be paid on or before 30.11.2017.

2.1.Furthermore, the learned counsel for the respondent says that the respondent will file an undertaking in the form of an affidavit, which would indicate that the payments will be made as per the time line set forth above.

3.The learned counsel for the petitioner says that having regard to the undertaking given on behalf of the

respondent, he does not wish to press the petition any further.

4.Accordingly, the contempt petition is disposed of based on the undertaking given on behalf of the respondent by his counsel Mr.Nithyesh Natraj.

4.1.As indicated above, the respondent will also submit an undertaking in the form of an affidavit on or before 30.10.2017.

5.List the contempt petition 'for reporting compliance', on 31.10.2017.
