Petition filed Under Article 226 of the Constitution of India praying to issue a Writ of Certiorari to call for the records of the Presiding Officer, Labour Court, Coimbatore relating to the impugned award dated 08.09.2017, quash the same as illegal, arbitrary and devoid of merits.

ORDER

The award dated 08.09.2017 is under challenge in the present writ petition.

2.The learned counsel appearing on behalf of the petitioner https://hcservices.ecourts.gov.in/hcservices/

made a submission that the petitioner/management is closed under Regulation 6 of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 and in this regard, a public announcement under Form A was also made and therefore, all the Creditors are at liberty to file their claim petitions before the Authority concerned.

3.In view of the fact that the Management is already closed, the respondent/workmen are at liberty to file their respective claim petitions before the Authorities Competent for the purpose of settling their dues.

4.Accordingly, this writ petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
