Respondents Civil Revision Petition filed under Article 227 of Constitution of India to dispose the E.P. No.763 of 2016 in I.A.O.P. No.7 of 2005 on the file of II Additional Subordinate Judge, Coimbatore.

ORDER

This revision petition is filed seeking direction to the Executing Court to dispose of E.P. No.763 of 2016 in L.A.O.P. No.7 of 2005 on the file of the learned II Additional Subordinate Judge, Coimbatore, as expeditiously as possible.

2. It is pointed out that the award was passed on 31.10.2013 and the claimants have not been paid any amount, even though their lands have been http://www.judis.nic.in acquired by the Government. It is also stated that E.P. was filed in the year 2016

vsi2 and the case is adjourned only for the purpose of filing the counter and ultimately the counter was filed on 14.07.2017. The copy of the counter is also enclosed along with the typed set of papers.

3. It is contended by the learned counsel for the revision petitioner that the counter did not disclose any arguable case on behalf of the respondent and therefore, there must be a direction to the Executing Court to dispose of E.P. within a limited time frame, to be prescribed by this Court.

4. Under the stated circumstances, without going into the merits of the matter, the executing Court is directed to dispose of the Execution Petition within the period of three months from the date of copy of receipt of this order.
