PRAYER : Writ Petition filed under Article 226 of Constitution of India, to issue Writ of Mandamus to direct the respondents to pay interest @ 10% for the belated payment of Gratuity, P.F.Leave Salary and commutation of pension amount to the petitioners. O R D E R

This writ petition has been filed to issue a Writ of Mandamus to direct the respondents to pay interest @ 10% for the belated payment of commutation of pension amount to the petitioners.

2. In the affidavit filed in support of the writ petition, it had been contended that the petitioners have retired from service on attaining the age of superannuation on 31.03.2023 & 28.02.2023 respectively from the respondents. It is contended that Gratuity, Provident Fund, Leave Salary and Commutation of pension amount were disbursed only on 30.10.2024 2/5

and 01.11.2024 for both the petitioners.

3. A direction is issued to the respondents that since it is a delayed payment, they should also pay interest @ 6% p.a. from the date of retirement till the date of actual disbursement. Necessary orders shall be passed within a period of three months from the date of receipt of a copy of this order.

4. With the above direction, the writ petition is disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 07.03.2025 dpq Index: Yes/No Speaking order / Non speaking order 3/5
