The petitioner / accused seeks bail in Spl. S.C.No.87 of 2023 now pending trial before the Special Judge For Exclusive Trial of Cases Under POCSO Act, 2012, Vellore.

2.Originally, the petitioner was arrested and remanded to judicial custody on 12.02.2024 for the offences punishable under Sections 363, 506(i) of IPC r/w. Sections 7 & 8 of POCSO Act, 2012 and Section 67 of IT (Amendment) Act, 2008 in Crime No.7 of 2023 on the file of the respondent.

3.It is stated that the petitioner was remanded to judicial custody but later bail was granted to him. It is the specific case of the prosecution that after he has been granted bail, the petitioner committed yet another repeat offence of similar nature against the same victim child, leading to registration of First Information Report in Crime No.548 of 2023. 1/2 https://www.mhc.tn.gov.in/judis

smv 4.It is thus seen that the victim child is extremely vulnerable and it would not be advisable to permit the petitioner to have the facility to once again commit the offence of physical assault against her. The petitioner absconded from judicial process on 24.11.2023. Non-bailable warrant was issued and he was secured on 12.02.2024. In the order dismissing bail dated 06.03.2024, the learned Special Judge had observed that the trial had been fixed for day to day examination of the witness. 5.At this stage, this Court is not inclined to grant bail to the petitioner. Let the trial proceed. Accordingly, this Criminal Original Petition stands dismissed.
