ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 296(b), 115(2), 118(1), 126(2) and 351(3) of BNS in Crime No. 44 of 2026, seek anticipatory bail.

2. The allegation against the petitioners is that they suspected the de facto complainant of passing on information regarding illegal sand theft. On such suspicion, the petitioners allegedly attacked the defacto complainant with stones, causing grievous injuries. Based on the occurrence, the present case has been registered.

3. The learned counsel for the petitioners submits that the petitioners have been falsely implicated and the injured has been discharged from the hospital and the petitioners are willing to cooperate with the investigation. Hence, he prays for anticipatory bail for the petitioners.

4. The learned Government Advocate (Crl. Side) reiterates the prosecution case, stating that both petitioners have bad antecedents. The first petitioner has three previous cases, and the second petitioner has six previous cases. She opposes to grant anticipatory bail to the petitioners.

5. Though the injured has been discharged from the hospital, considering the petitioners' bad antecedents and the motive behind the occurrence, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
