Review Application No.103 of 2013 in A.S.No.25 of 2009 and A.S.No.63 of 2022 Dr.G.JAYACHANDRAN,J.

The learned counsel appearing for the review petitioner, by way of mentioning, brought to the notice of this Court that the last three lines of paragraph No.23 in the order dated 17.06.2025 passed in the review application are ambiguous and require clarification.

2. This Court on perusing the paragraph No.23 of the review order, finds that the final paragraph No.23 requires clarity. Hence, the last three lines of paragraph No.23 are deleted and the following sentence is substituted. Further, in the second line of paragraph No.23 the word "decree" shall be deleted and replaced with the words "judgment and decree".

"The parties shall proceed with fresh final decree application as per judgment in O.S.No.119 1/3

of 2006, dated 22.01.2008."

3. After the said substitution, Paragraph No.23 of the review order dated 17.06.2025 shall read as under:- "23.In view of allowing the review application and dismissal of A.S.No.25 of 2009, the judgment and decree dated 13.08.2012 in A.S.No.25 of 2009 gets set aside. Consequently, final decree passed in I.A.No.533 of 2013 in O.S.No.119 of 2006 stands set aside. Therefore, A.S.No.63 of 2022 filed against the final decree stands disposed of. The parties shall proceed with fresh final decree application as per the judgment in O.S.No.119 of 2006 dated 22.01.2008." 07.11.2025 ari Note:

Registry is directed to issue a fresh order copy to the parties concerned.
