Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, calling for the records and order of the 4th respondent dated 31.01.2025 in Na.Ka.No.O1/14246/2024 and quash the same as illegal and further directing the respondents to allow the petitioners to work in their respective schools from 31.01.2025, the date of cancellation of appointments. ORDER

This Writ Petition has been filed in the nature of a Writ of Certiorarified Mandamus seeking to call for the order of the 4th respondent dated 31.01.2025 in Na.Ka.No.O1/14246 of 2024 and to quash the same and further seeking a direction against the respondent to allow the petitioners to work in their place of appointment from 31.01.2025. 2.The four petitioners namely, M.Thangadurai, M.Ramya, K.Maheswari and K.Umadevi had earlier filed W.P.No.32612 of 2024 questioning the order of recruitment process through which the petitioners herein had been recruited to the post of Graduate Teachers / Block Resource Educators (BRTE) in school education and other departments. By an interim order, the recruitment process was directed to be kept in abeyance.

But, inspite of such specific order passed by a learned Single Judge of this Court, the respondents herein had proceeded further with the recruitment and had completed the recruitment process and proposed the names of the petitioners herein for appointment. This necessitated Cont.P.No.4018 of 2024 to be filed by the four writ petitioners in W.P.No.32612 of 2024. By an order dated 22.01.

recruitment could not withstand the scrutiny of this Court. 3.The learned counsel for the petitioners interprets the order in the Contempt Petition as an order directing the respondents to apology for the recruitment done. But, in uncertain terms, the learned Single Judge stated that the recruitment process had been proceeded inspite of the fact that the recruitment process had been directed to be kept in abeyance. Consequent to such observations, the appointment of the petitioners herein had been cancelled by the respondents by way of an impugned order dated 31.01.2025 in Na.Ka.O1/14246/2024.

4.The learned counsel for the petitioners made a fervent plea that the petitioners had accrued a right of employment consequent to being appointed and also stated that the petitioners have shifted their place of residences to the places where they had been posted and that the impugned order has caused much difficulty to the petitioners. But they will have to join issue in the pending writ petition in W.P.No.32612 of 2024. There could be an alternative view also expressed that the present writ petition could be tagged along with W.P.No.32612 of 2024. But, that would only lead to

multiplicity of proceedings.

5.The petitioners can very well join in W.P.No.32612 of 2024 and the issues relating to the procedure adopted in the recruitment process can be heard and decided in that particular writ petition. Giving that small window to the petitioners herein, I am afraid that it would not be judicial discipline to uphold the recruitment process in any manner whatsoever and permit the petitioners to continue in the employment in the light of the order of the learned Single Judge dated 22.01.2025 in Cont.P.No.4018 of 2024. 6.With the above observations, this Writ Petition stands dismissed, however, giving liberty to the petitioners, if they so choose so, to join as respondents in the aforementioned writ petition in W.P.No.32612 of 2024.
