The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 120B, 420, 465, 467, 468,471 of IPC in Crime Nos.235 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that on 29.10.2022, the petitioner and other accused persons have availed loan for a sum of Rs.10,00,00,000 by using fabricated and forged document from the defacto complainant's bank. Since the EMI for the said loan has not been paid by the petitioner and other accused persons. Hence, the complaint.
3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has been falsely implicated in this case. He also submit that earlier anticipatory bail petition in Crl.O.P.No.3990 of 2023, was dismissed by this Court on 28.02.2023. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate (Crl.Side) would submit that the petitioner along with other accused persons had obtained a loan by pledging the said properties. On verification it is seen that the said properties were sold
long back. Since they produced fabricated documents and obtained loan to the tune of Rs.10,00,00,000/- (Rupees Ten Crores Only). Hence, he vehemently opposed to grant anticipatory bail to the petitioner. 5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent police and perused the materials available on record.
6.Admittedly the petitioner along with other accused persons obtained loan from the defacto complainant based on fabricated documents which was sold long back. Since there are chances of tampering the evidences and needs a detailed enquiry in this regard, and there is no change of circumstance, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 05.04.2023 rri
