JUDGMENT

[Judgment of the Court was pronounced by R.SUBBIAH, J.] The present appeal has been filed by the appellant, challenging the order dated 4.9.2013 passed by the learned II Additional Principal Judge, Family Court, Chennai, ordering pendente lite maintenance in favour of the respondents herein at the rate of Rs.5,000/- each together with Rs.5,000/- towards litigation expenses, pending disposal of the main original petition.

2. It is now represented by the learned counsel for the appellant that the main original petition itself has been dismissed for default and therefore, the relief sought for in the present appeal has become infructuous. The learned counsel for the appellant has also made an endorsement to the said effect. Recording the same, the civil miscellaneous appeal is dismissed as infructuous. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed.
