PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents 1 and 2 to take appropriate action against the respondents 3 and 4 College, more particularly the 2nd respondent may direct to cancel the affiliation to the 3rd respondent College as per the announcement dated 14.10.2011 and further to direct the respondents 3 and 4 to pay a compensation a sum of Rs.20,00,000/- to the petitioner for using his name for getting affiliation and for illegal termination of his service.

ORDER

This Writ Petition has been filed for direction directing the respondents 1 & 2 to take appropriate action against the respondents 3 and 4 and also to cancel the affiliation to the third respondent.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner has qualified with B.Sc (Physics), M.Sc., (Applied Science), M.Phil and Ph.D. The fourth respondent has started new 2/4

Engineering College during the Academic Year 2011-2012. The said College recruited teaching and non-teaching staffs including the Assistant ProfessorPhysics. The petitioner also applied to the said post and the fourth respondent conducted interview. The petitioner was selected to the said post and he had joined duty on 01.07.2011 before the third respondent College. However, the third respondent has not issued any appointment order. Therefore, the petitioner submitted a representation to take appropriate action. Though the petitioner was selected to the said post, he was not issued with any appointment order. Even before date of appointment, the petitioner has no right to seek any direction to take appropriate action as against the respondents 3 and 4 herein.

4. In view of the above, the prayer sought for in this Writ Petition cannot be considered. Thus the writ petition is devoid of merits and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. There shall be no order as to costs.
