ORDER

The prayer made in this writ petition is to call for the records relating to the Memorandum No.6207/OTD-B2/2010, dated 08.11.2013 passed by the respondent and quash the same and consequently, direct the respondent to appoint the petitioner in any of the existing vacancy as Assistant in the Rural Development.

2.Upon notice, the respondent filed a detailed counter affidavit, inter alia stating that for getting appointment to the post of Assistant, the prescribed qualification is a degree and that, it should be obtained in the pattern of 10+2+3 as announced under Note (1) in para 4(B) of the Notification No.258 dated 30.12.2010, whereas the petitioner acquired her PG degree through Distance Education without obtaining HSC and basic degree and hence, her application was rejected subsequently and she was not permitted to attend the counseling, by the order impugned herein.

3.However, today, when the matter was taken up for consideration, the learned counsel for the petitioner, on instructions, submitted that the relief sought for herein has become infructuous and hence, nothing survives for adjudication in this matter.

4.In view of the above submission made by the learned counsel for the petitioner, the writ petition is dismissed as having become infructuous. No costs. Consequently, connected Miscellaneous Petition is closed.
