JUDGMENT

When the matter was taken up for hearing, learned counsel appearing for the appellant submitted that the appellant is no more. He has also submitted that the letter sent to the appellant was returned with a postal endorsement "expired" and filed an affidavit of service.

2.In such view of the matter, the second appeal is dismissed as abated, however, with liberty to file appropriate application, if so advised. No costs. Consequently, connected miscellaneous petitions are closed.
