ORDER
Today, the matter is listed under the caption "For Withdrawal" based on the letter dated 18.09.2025 submitted by the learned counsel appearing for the petitioner to the Registry. The learned counsel for petitioner sought permission of this Court to withdraw this petition submitting that the prosecution filed a petition in Crl.M.P.No.1433 of 2025 before the learned XIII Additional Civil Judge for CBI cases, City Civil Court, Chennai for withdrawal of prosecution against the petitioner/A2/M.A.Narayanan. The learned XIII Additional Civil Judge, by the order dated 02.08.2025, allowed the petition and discharged the petitioner from the charges and closed the case. The learned counsel made an endorsement in the petition. He further submitted that the other beneficiaries filed discharge petitions before this Court, which were dismissed, aggrieved over the same, they filed appeal before the Hon'ble Apex Court and the Apex Court allowed the SLP and quashed the cases against them.
2. The learned Special Public Prosecutor appearing for the respondent submitted that the case is with regard to false and ineligible duty drawback availed by the exporters, as against the customs officials departmental action taken and prosecution launched against the exporters/beneficiaries. Now CBI Page No.2 of 4
withdrawn prosecution against the petitioner/A2 and the petitioner no more an accused in C.C.No.01 of 1998. Hence, nothing survives for adjudication in this case.
3. In view of the above submissions and endorsement made by the learned counsel for petitioner, this Criminal Original Petition is dismissed as withdrawn. Consequently, the connected Criminal Miscellaneous Petition closed.
