The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 5, 7(3) of Lotteries Regulation Act, 1998, in Crime No.82 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner/A2 is the agent of A1 who was found to be in possession of banned lottery tickets. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case based on the confession statement recorded from the 1st accused. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner along with other accused involved in selling banned lottery tickets to the public. He would further submit that the petitioner is a habitual offender and there are four previous cases are pending against the petitioner. Therefore, he vehemently opposed for grant of anticipatory bail to the petitioner.

5. Taking into account the nature of offence and the previous antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
