Civil Revision Petition is filed under Section 25 of the Tamil Nadu Buildings (Lease and Rent) Control Act, 1960 to set aside the fair and decreetal order passed by the learned Rent Control Appellate Authority (Sub-Judge), Udhagamandalam made in R.C.A.No.1 of 2019 dated 18.12.2019, confirming the fair and decreetal order of the learned Rent Controller, Udhagamandalam made in R.C.O.P.No.44 of 2013 dated 30.11.2018.

O R D E R

The Civil Revision Petition has been preferred challenging the order of the learned Rent Control Appellate Authority, Udhagamandalam dated 18.12.2019 made in RCA.No.1 of 2019.

The revision petitioner is the tenant, against whom the respondent has filed Election Petition in RCOP.No.44/2013 on the ground of willful default and the said petition was allowed on 30.11.2018. The tenant, challenged the same by way of preferring RCA.No.1/2019 and the same was also dismissed on 18.12.2019. Aggrieved over that the present CRP has been preferred.

However, when the matter was taken up, the learned counsel for the petitioner fairly concede that the revision petitioner would vacate the premises in compliance of the orders of the Court, provided he is given with some more grace time to vacate the premises.

Learned counsel for the respondent is present and he also conceded the request on the condition that the revision petitioner should abide his undertaking.

Considering the mutual submissions made by the learned counsel, I feel that a three months time can be given to the petitioner to vacate the premises.

In view of the above stated reason, the Civil Revision Petition is disposed of. Time to vacate the premises is three months. Consequently, connected miscellaneous petition is closed. No costs. 20.07.2022 AT Index:yes/No Internet:yes/No 3/4
