O R D E R

When the matter came up for hearing, the learned counsel appearing for both sides submitted that the writ petition itself could be disposed of in terms of paragraph No. 7 of the counter affidavit filed by the third respondent. Paragraph No. 7 is extracted hereunder:

"7. I once again at the risk of repetition reiterate that the 4th Respondent i.e. my son and the Petitioner i.e. my daughter-in-law are taking good are, maintenance, food, residence, clothing, medical and health care and other necessities. I have no objections in the settlement deed dated 19.11.2012 registered as Doc.Nos. 2491 of 2012 executed by my husband Late Mr.S.Palraj in favour of my son Mr. B.Saravanan being restored. I submit that I am filing this Counter Affidavit out my free will, volition and I have not been coerced by the 4th Respondent or the Petitioner.

For the reasons stated above, it is prayed that this Hon'ble Court may be pleased to allow the Writ Petition in W.P.No.8152 of 2025 by setting aside the order dated 18.03.2022 bearing P.No.A3/3181/2021 passed by the 2nd Respondent and thus render justice."

3. In view thereof, this Writ Petition is allowed. The impugned order in Sa.Mu.A3/3181/2021, dated 18.02.2022, passed by the second respondent is hereby set aside, and the Sub-Registrar shall also cancel the entry of cancellation, if any, already made.

There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
