Respondents Prayer:- Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the Respondents 1 to 5 to take control and supervise the "Thee Midhi Thirivizha" festival of Arulmigu Muneeswara Angala Eswari Temple, situated at Burma Nagar, Pandianallur, Chennai - 600 052, proposed to be conducted on 24.03.2019, by the Respondents 6 to 9 illegally.

O R D E R

The Writ Petition has been filed for a direction to the First to Fifth Respondents to take control and supervise the "Thee Midhi Thirivizha" festival of Arulmigu Muneeswara Angala Eswari Temple, situated at Burma Nagar, Pandianallur, Chennai - 600 052, proposed to be illegally conducted by the Sixth to Ninth Respondents on 24.03.2019. 2.

The Sixth to Ninth Respondents have filed Counter Affidavit contending that from the day of inception of the Temple, only the repatriates from Burma were conducting all festival for the past 54 years and no one has raised any objection in this regard, but the Petitioner, who has approached this Court with unclean hands, had filed this Writ Petition only to stall the festival in the midst of the arrangements made.

A status report has been filed by the Takkar/Fit Petrson of Arulmighu Muneeswarar and Arulmighu Angala Eswari Temple stating that the Temple admittedly comes under the administrative control of the HR & CE Department and the festival has been conducted in a peaceful manner with the assistance of the police authorities without any law and order problem. In view of the aforesaid submissions made, nothing survives for further adjudication in the Writ Petition.

Accordingly, the Writ Petition is disposed. No costs.
