ORDER : The Court Made the following order :- The petitioner who was arrested on 09.03.2021 and remanded to judicial custody for the offences under 392 @ 395 of IPC in Cr.No.59 of 2021 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the defacto complainant is the driver of the tipper lorry and when the defacto complainant was returning after uploading red sand, 4 persons who came in a bike stopped the lorry and they asked the petitioner to get into the lorry along with other co-accused and said that the owner of the lorry had to repay Rs.5,00,000/- to them and hence, they are confiscating the lorry and the defacto complainant was dropped near the toll gate. Hence, the complaint.
3.The learned counsel appearing for the petitioner submits that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of bail to the petitioner. 4.The learned Additional Public Prosecutor submits that there are two previous cases against the petitioner. 5. Taking into consideration the facts of the case and further the petitioner is having two previous cases, this Court is not inclined to grant bail to the petitioners.
