According to the revision petitioner, the revision petitioner has filed an application in IA.No.23 of 2015 in OS.No.28 of 2014 under Order 40 Rule 1 of the Civil Procedure Code. In the aforesaid application, the respondents have filed counter affidavit and posted for
enquiry on 14.12.2015. Thereafter, the said application has been adjourned from time to time and the same pending before the court below. Hence, the revision petitioner has filed the present Civil Revision Petition before this Court to issue direction to the court below to dispose of the said application within the time frame as may be fixed by this Court.
2. By considering the facts and the submissions made by the learned counsel for the revision petitioner, without expressing any opinion on merits, this Court is inclined to direct the Principal District Court, Villupuram, if there is no other legal impediment, to dispose of the IA.No.23 of 2015 in OS.No.28 of 2014 in accordance with law as expeditiously as possible preferably within the period of twelve weeks from the date of receipt of a copy of this Order.
3. The Civil Revision Petition is disposed of with above direction. No costs.
