ORDER
This petition has been filed seeking a direction to the respondents to defer the enquiry proceedings based on the charge memo issued by the 2nd respondent in R.No. 22865/ A2/ 2018 dated 12.11.2020 and consequent notice of enquiry issued by 3rd respondent in Ku.No. 18871/ A2/ 2023 dated 29.2.2024 till the conclusion of the criminal case re-numbered in Spl. C.No. 15 of 2024 on the file of Judicial Magistrate Court, Kallakurichi based on the Charge Sheet No. 06/ 2020 dated 23.11.2020.
2. It is the case of the petitioner that the petitioner was initially appointed as Motor Vehicle Inspector Grade II in Transport Department on 15.03.1991. Subsequently, he was promoted as Motor Vehicle Inspector Grade I in the year 1988. On Muthukumar running a Driving School in Kallakurichi, lodged a false complaint to DVAC on 10.09.2018 alleging that the petitioner demanded money for renewal of FC in respect of vehicle TN 31 AY 0678 to one Ramesh. The said complaint was registered by DVAC in Cr.No.28 of 2018 under Section 7 of DVAC Act 1988. Thereafter a false trap was arranged as if money was received by the petitioner and handed over to one Senthilkumar and statements were recorded. Thereafter, the petitioner was placed under suspension on the false case implicated against him and charge sheet has been filed. While so, the
second respondent issued departmental proceedings against the petitioner by issuing charge memo dated 12.11.2020 alleging demand of money. The Enquiry Officer conducted enquiry. In the meanwhile, the petitioner made a representation to the 3rd respondent to defer the enquiry on the charge memo dated 12.11.2020 and the same is pending. Hence, the present writ petition.
3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioner's representation within the stipulated time as fixed by this Court.
4. The learned Additional Government Pleader appearing for the respondent submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.
5. Heard the learned counsel for both side and perused the materials available on record.
6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the 3rd respondent to consider and pass orders on the petitioner's representation dated 12.11.2020 within a period of four weeks from the date of receipt of a copy of this order.
