This application has been filed to issue a subpoena to Mr.S.Jaganathan, No.5/11, 15th Cross Street, Shastri Nagar, Adyar, Chennai - 600 020 to appear before this Court and give evidence in T.O.S.No.6 of 2018.

2. The learned counsel for the plaintiff submitted that the suit has been filed for grant of Letters of Administration on the basis of the Will dated 26.03.1984 alleged to have been executed by the plaintiff's father; since the plaintiff has to necessarily examine one of the testators in order to prove the Will, subpoena should be ordered.

3. However, the learned counsel for the respondent / defendant submitted that the application should be allowed without prejudice to his contentions.

4. It is needless to state that the respondent has got his opportunity to cross-examine his witnesses and hence allowing this application will not have any impact on the submission made by the respondent in his written statement.

5. Hence, this Application is ordered.
