Respondent(s) PRAYER: This criminal original petition has been filed under Section 528 of BNSS 2023 to set-aside the order passed by the learned XXIII Metropolitan Magistrate Court at Saidapet, Chennai in Crl.M.P.No.1120 of 2025 dated 18.02.2025 and to relax the condition imposed on the petitioner in Crime No.261 of 2024.

ORDER

This criminal original petition has been filed to to set-aside the order passed by the learned XXIII Metropolitan Magistrate Court at Saidapet, Chennai in Crl.M.P.No.1120 of 2025 dated 18.02.2025 and to relax the condition imposed on the petitioner in Crime No.261 of 2024. 2.

Learned counsel appearing for the petitioner would submit that after registering the FIR in Crime No.261 of 2024, the petitioner was arrested and released on the same day by the learned XXIII Metropolitan Magistrate Court, Saidapet on 18.01.2025 with one of the conditions that the petitioner shall appear before the respondent police every Monday and Friday at 10:00 a.m., for a period of eight weeks; that the petitioner had complied with the condition for few weeks and filed a petition in Crl.M.P.No.1120 of 2025, for relaxing the said condition before the learned XXIII Metropolitan Magistrate Court, Saidapet and the same was dismissed on 18.02.2025; that the petitioner is still complying with the said condition and prays to set aside the order in Crl.M.P.No.1120 of 2025 dated 18.02.2025 and to relax the aforesaid condition imposed on the petitioner.

The learned Government Advocate (Crl. Side) confirms the fact that the petitioner is complying with the condition imposed on him till date; and that the investigation is pending.

Considering the submissions made by the learned counsels on either side and nature of offence, the condition imposed on the petitioner to appear before the respondent police every Monday and Friday at 10:00 a.m., for a period of eight weeks is relaxed to the effect that the petitioner shall report before the respondent police as and when required for interrogation, accordingly, the condition imposed by the learned Magistrate is modified. 5.

Accordingly, this criminal original petition is ordered. 10.03.2025 stn To
