Civil Revision Petition is filed under Article 227 of the Constitution of India to set aside the impugned order dated 29.08.2017 passed by the Learned Sub Court at Kancheepuram in Unnumbered O.S.S.R.No.8485 of 2017 and direct the Hon'ble Sub Court, Kancheepuram to number the suit.

O R D E R

According to the learned counsel for the petitioner, the trial Court has rejected the plaint, with respect to Clause 3 of the prayer in the plaint. On instructions, the learned counsel for the petitioner submitted that he is not pressing clause 3 of the prayer in the suit and seeks liberty to represent the plaint before the trial Court, deleting clause 3 of the prayer. He has also made an endorsement to that effect.

2. In view of the above submission, the petitioner now seeks for withdrawal of the above said Civil Revision Petition, with liberty to represent the plaint, in so far as the 1st and 2nd claim in the prayer, in paragraph 16 of the plaint.

3. Hence, this Civil Revision Petition is dismissed as withdrawn, with liberty to the petitioner to represent the plaint, in so far as the 1st and 2nd claim in the prayer, in paragraph 16 of the plaint and deleting the 3rd claim. No costs.
