For Petitioner : Mr.Guruprasad (in both WPs) for Mr.S.Balasubramaniam For Respondents : Mr.U.Baranidharan (in both WPs) Special Government Pleader for R1 & R2 COMMON ORDER These writ petitions have been filed for a direction to the second respondent to register the pending sale deeds both dated 02.05.2024, and to release the same.

2. When the matters are taken up for hearing on 12.03.2025, this Court directed the learned Additional Government Pleader to take instructions.

3. Today, when the cases are taken up for hearing, the learned Special Government Pleader produced the written instructions in both the writ petitions. In the written instructions, it is stated that the subject properties along with the other lands in the same survey number has been dealt with as house-sites and various documents have been registered, by showing them as house-sites. Hence, the petitioner cannot be allowed to deal with the subject property as 2/5

agricultural land. If necessary approval has not been obtained, such registration will be barred under Section 22A of the Registration Act.

4. In the light of the above stand taken by the second respondent, there shall be a direction to the second respondent to issue a refusal check slip by citing the reasons within a period of one week from today. If the petitioners are aggrieved by the same, it is left open to them to work out the remedy in accordance with law. On the alternative, if the petitioners find that they have to get an approval under the relevant rules, they can get an approval and thereafter, the petitioners can present the documents for registration.
