ORDER

This petition has been filed seeking to quash the order passed by the 3rd Respondent in Ka.N. 1588/2021, dated 02.09.2022 and consequently directing the 3rd Respondent to issue license to the Petitioner in Gandhi Mens Self Help Society, Mettur Taluk in Shop No. 73, situated at Uzhavar Market, Thottilpatti, Mettur Dam, Salem District.

2. When the matter is taken up for hearing, the learned counsel for the petitioner submitted that without going into the merits of the case, this Court may permit the petitioner to file a fresh application for allotment of new shop.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Additional Government Pleader has not raised any objection in this regard.

5. Heard the learned counsel for both side and perused the materials available on record.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court without going into the merits of the case and without interfering with the impugned order, permits the petitioner to make a fresh application before the third respondent for allotment of the shop within a period of two weeks from the date of receipt of a copy of this order. Upon receipt of the same, the third respondent shall consider and pass orders within a period of two weeks thereafter.

7. With the above directions, the writ petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
