ORDER

Heard Mr.C.K.Chandrasekar, learned counsel for the petitioner and Ms.N.Parimala, learned counsel for the respondent.

2. The petitioner is the wife in matrimonial proceedings in HMOP No.57 of 2022 which was initiated by her before Subordinate Court, Devakottai when she was residing in Devakottai. However, subsequently, as seen from the 1/4

affidavit, filed in support of the petition, the petitioner/wife has shifted back to Chennai after working in Mangalore and now, she expressed her inconvenience to attend the hearings at Devakottai. The petitioner also states that she has to take care of her minor child, 3 years old boy.

3. I have gone through the affidavit filed in support of the transfer petition. The petitioner has assigned genuine and acceptable reasons for being unable to attend the hearings at Devakottai.

4. In view of the above, this Court is of the opinion that the petitioner has made out a case for transfer of the suit, as prayed for.

5. Accordingly, the Tr. C.M.P. No.270 of 2025 is allowed and HMOP No.57 of 20222 pending on the file of Subordinate Court, Devakottai is withdrawn and transferred to the file of the Principal Family Court, Chennai.

6. The Subordinate Court, Devakottai is directed to send the entire records relating to HMOP No.57 of 2022 to Principal Family Court, Chennai forthwith.

7. The learned Judge, Principal Family Court, Chennai is directed to take 2/4

up the matter either by himself or transfer to any Additional Family Courts, taking into account the pendency of the cases before the Family Court, Chennai.
