2020-02-28Honourable Mr Justice T. S. Sivagnanam2 pages

W.P.No.35531 of 2015 M. DHANDAPANI, J.

When the matter is taken up for hearing, learned counsel for the petitioner submits that the petitioner's land was acquired in the year 1981 under the Tamil Nadu Acquisition of Land for Harijan Welfare Schemes Act, 1978. Thereafter, the value of the acquired land was fixed by the 2nd respondent herein, against which, LAOP No.31 of 1981 came to be registered on the file of SubCourt, Tiruvannamalai, in which, the value of the acquired land was enhanced from Rs.37 to Rs.100 per cent. Being not satisfied with the same, Appeal suit in A.S.No.91 of 1999 was filed before this Court, in which, the Division Bench of this Court had enhanced the compensation amount from Rs.100 to 150 per cent vide order dated 20.04.2004. However, the enhanced compensation has not been paid to the petitioner, has prompted the petitioner to file the present petition.

2. The grievance of the petitioner is that though the subject land was acquired in the year 1981, however, from the year 1981 to till date, despite the order of this Court, neither the compensation amount was fully paid to the petitioner nor the counter was filed on behalf of the respondents in the present case.

3. Hence, the Respondents 1 & 2 are directed to file a report of compliance of the aforesaid order of this Court in A.S.No.91/1999, on or before 28.04.2022, failing which, the respondents 1 & 2 are directed to appear before this Court on 28.04.2022.
